Need urgent help

(Querist) 03 February 2013 This query is : Resolved
Respected all,

Can I appeal in session court if trial court has passed order u/s 202 of crpc for my complaint?

if court is running a case upon the detail and that detail is the base of my complaint then How police will investigate when court is running the case and passing orders.

details,
my wife filed complaint with known false information to cover the offences she had committed with me and with my family members.

I filed application u/s 340 crpc and submitted facts, list of documents. but trial court rejected the application of u/s 340 crpc.

I prefer to go for trial after then and filed complaint for the issues upon the same detail u/s 417,420, 387,389,120 of ipc.

what orders have passed by trial court upon known false information and known false sworn affidavit are the part of list of documents in my complaint and what orders in future trial court will pass will become the part of my complaint.

thus court is running a case upon known false information, filed complaint of my wife, her submitted doc. are the part of list of documents of my complaint.

thanks in advance

If your 340 application has been rejected by court then you might have gone under section 397 (1) of Criminal procedure code either before Sessions Court or High Court instead of preferring a separate criminal complaint if the offence has been committed by your wife during the trial of her pending cases.

Magistrate may send the complaint to the police authorities under section 202 but if you are not satisfied file revision thereto.
