How to file suit against employer

Hi,

I used to work with an IT Company based in Bangalore.
Joining Date - 03-Jan-2011
Last Working Date - 23-Dec-2011
Salary not paid - Dec 2011
Month’s Salary Not paid - 1 month
Relieving Documents - Collected
Post resignation, I have repeatedly contacted them, and have received response from the official mail id's of the Finance and HR , about salary payment, they are just giving new dates each time...but no pending salary has been credited during this period.

My Queries:
1. Whom to approach - Labor Court or Civil Court
2. Supporting Documents required - Like Joining letter, pay slips, reliving letter, mails informing dues pending?
3. Penalty - Can I claim interest, harassment charges, legal expenses etc

If you are workman,,you have to file complaint with the labour officer. If not workman,you have to file suit for recovery with interest.
