Dear experts,
A PERSON filed a case aganist XYZ for claming some amount which the same is already paid on behalf of XYZ.after due enquiry the hon'ble court dismissed the suit.now XYZ wants to file a criminal case aganist the PERSON for cheating and extortion and also for defamationIs it tanable in the court of law.kindly advice on this aspect.

Since the civil suit s dismissed the criminal case would meet the same fate soon.
You may however try for quashing in the meantime.

you have been exonerated in civil case . court has passed order in your favour . why do you want to file criminal case and spend your valuable time and money on legal fees . forget it
