We have a room at Khar,Mumbai. we had formed a proposed Society and handed over to builder for Redevelopment. agreement is signed between owners and builder. but after 7 years it is still not developed. Meanwhile we had given our room to Builder to use it as Transit Camp, for which he paid us minimum rent. we have been requesting him to return our room back so we can use it.
1. He had agreed and issued letter to his tenants residing at the place to vacate the house (2 years back).

2. Tenants are not vacating it.They have been alloted room in the other transit camp. which they are already using, but demanding more space.

3. Rent due has been paid by the builder till October 31st on humanity grounds.

4. We dont know what to do further. pls advice.

P.S. I am writing this on behalf of the owner who is 67 years old lady with no financial support. she had a heart attack due to these tensions. She has been running from pillar to post all these years.

if tenants are not delivering vacant posession how will builder carry on construction ? it is necessary to go through the provisions of agreement signed with the builder . contact a local lawyer

Enforce the terms of the agreement by way of recourse to law. Filing suit for eviction seems the only plausible option left.
