Mortgage

(Querist) 12 October 2012 This query is : Resolved
We had applied for redemption suit for mortgage in additional civil court based on observation made by another court during the another case for permanent injection.

While ariving the limitation period by the additional Civil court,it has not eliminated the period during which the issue was under other court and concluded it is barred by time

Can someone suggest whether it is correct poistion or wrong?
what is the alternatvie availabe for us, should we go for appeal or can we go for reivew of the judgement with same judge?
adv. rajeev ( rajoo ) (Expert) 13 October 2012
Civil court order is correct, another case order cannot be considered to count the limitation period.
