Cyber crime section 66 a

My old roommate and i had a fight because he was my senior in college and we had batch fights. we split up 3 years before and 2 years before the police and my batch mates put a total of 8 cases against him for ragging and kindapping,wrecking a police vehicle,etc.and after that had no news what happened to him. Now i got a summons from the court from his home town that i hacked his e-mail. I got an anti -bail and checked things to find out that he himself put some pic's of his old girl friend and changed his password and now claims that i have did it from our old neighbours house since we didnt have internet connection we used our neighbours connection those days.I am working and planning of going abroad when this came up.how should i handle this??

Well you have now no choice but to fight this case which does not mean you can not go abroad.
Do join your job but you would be required certain stages of trial for your physical presence.
Quashing is an option though if there is merit.

When a case is filed in a court of law, it is incumbent upon the prosecutor to prove the offence beyond any doubt. Let him prove how and when you hacked his email account.

However, being defendent in a criminal case, you cannot escape from attending the court to defend your case and prove your innosence.

It seems it might take 5-6 month for the next hearing.I am planning of asking an advanced hearing but the witness he's given 2 are abroad and married, so will it matter if they dont appear.?

I also want to prove my innosense so that i can also get relief. but the court hearing are very slow. how much time do you thing the trail will last.

Nobody can guarantee about period of trial. Depends solely upon the evidence in your favour and how effectively and promptly your own lawyer can bring to the notice of the court by countering the arguments of the prosecution.
