How to get heir certificate for a person who was dead in 1947

(Querist) 19 July 2012 This query is : Resolved
Hi
The person is having one daughter and a son(My Father). I came to know that the daughter does not have any rights to claim on property owned by her father who died before 1956.

1) But is it necessary to get a heir certificate since all the property is still in my grandfather's name only and even my father is dead. I want to change the property to my mother's name.

2) If yes, how to get the heir certificate.

You shall have to apply it to the local Talathi/Tehsildar who shall forward it to local Patwari (village revenue officer) who shall affirm the detail of legal heirs of your grand father and then of your father and accordingly shall report and thereafter Talathi shall issue the desired certificate.
