Company expecting services 24*7 from its employees.

Dear Sir/Madam

Greetings!

I want to present a scenario of telecom business where one of the deptt called BSS demands for working 24*7 without adequate Compensation.

A BSS Engg is expected to receive calls from Network Operations Center(NOC) for 24hrs and simultaneously follow with Technicians in field for restoration of sites(towers).

His day starts with Site Visits and Continously moving to different sites for different activity and he often works for more than 8 hrs in normal circumstances. he then has to make special moves anytime if there is outage on sites even if he has worked for 12 hrs in day but an outage in night means he has to move to site immediately.

And for such harsh Services he is paid a meagre amnt of 15K-20K.What does labour law suggest for such kind of Working Scenario as this is a standard norm in telecom Industry for Field Engineers and can be easily proved in any Court of Law.

He being Engineer , I understand he is a Management Staff.

So his Employment is not restricted to any hours a day or timings, and he need to attend to such phone calls, and work as per Company requirement. The Amount of Salary is not a criteria or deciding factor.
If the said Engineer is not happy, he is free to change his employer.
He is entitled to unlimited Sick Leave, Taxi fare & transport etc whenever called for duty beyond office hours [say 10-5]

Thanks Mr Shroff and Mr Sethi for your valuable suggestions and feedbacks.

Well the situation explained to you is current scenario in Telecom Industry at Circle Level and I was wondering if it falls within Indian Labour laws.

The above situation is not my personal situation but being part of telecom Industry I wonder about Occupational Health and Safety , Employee Satisfaction and other aspects of working in an organisation.

Organisations today hire Engineers at the lowest level of Heirarchy and rest other work if any are outsourced to contractors and 3rd party employees who are made to slog even more.So basically Engineers are Labours for a Technology Company and I wanted to know what does Indian law and other International Standards say about the above mentioned working Condition.
