UNREGD.SALE AGREEMENT ENTERED TO SELL. BUYER DID NOT TURNUP TO PAY BALANCE AND GET SALE DEED EXECUTED FOR 3YRS.8MONTHS DESPITE REPEATED REQUESTS. ASPER AGREEMENT HE WAS TO PAY BALANCE AND GET SALE DEED 3YRS 5MONTHS AGO. NOW HE HAS COME AND STARTED PRESSURISING TO GET REGISTRY AT AGREED RATE OR REFUND HIS ADVANCE MONEY. SHOULD I SUBMIT TO HIS PRESSURE OR REFUSE STRAIGHTWAY AND ALLOW HIM TO DO WHATEVER HE LIKES AS IN BOTH CASES I AM SUFFERER AS PRICES HAVE GONE UP. CAN HE LEGALLY HARASS ME.

how much was advance money? was their a lcuase in agreement that advance money would be forfeited in case of failure to pay balance amount .

RESPECTE SETHI JI, ADVANCE WAS 30PERCENT AND THERE WAS CLAUSE TO FOREFEIT MONEY

if you hve acted as per terms of agreement you have nothing to fear . he had sufficent time to make payment . he failed to do so . nor did he file suit for specific performance . although forfeiture of 30%advance payment seems to be high .
setlle with him . retain 5%and refund 25%^

It is better to settle mutually, rather than getting into hot boiled arguments and litigation.

Dear Mr. Kamal, I also agree with expert Ajay sethi advice to settle down the issue by paying refund of 25%. Also I would like to add up that Pls engage a ADVOCATE to see that proper documentation pertaining to CANCELLATION OF SALE AGREEMENT IS DONE & REGISTER THE SAME to avoid any future claims.
