Salary payment and reliving certificate

(Querist) 30 April 2012 This query is : Resolved 
I worked for a Pvt Ltd., for 8 months. I have resigned my job and sent resignation by E-Mail to my MD and he accepted it immediately by reply mail. There was no Notice period to work in my offer letter, even though I have worked for 5 days after my resignation to finish the pending works. I need to get last 15 days salary from this company.
I joined with another new company without submitting my reliving letter from my previous employer.
My previous employer is not ready to give my pending 15 days salary and reliving certificate. Hence, I would like to take action according to law on him.
Hence, I am requesting you please let me know under what provisions I can take action on him and what are the legal remedies I have.

You are required to send a notice to the previous employer demanding the unpaid salary and the relieveing letter and experience certificate within 15 days or so. If they fails to give the same, then you are required to approach the labour commissioner to file a petition to that effect

you should send a legal notice to your company through a lawyer and demand your 15 days salary and relieving letter with the interest and compensation, if the company are not ready to give your money you have right to file a case before labour court against the company and directors.

since the appointment letter did not mention any notice period and your rejection was accepted immediatedly the company is bound to give you a relving letter .

if the company is willing to give reliving letter without salry for 15 days grab it immediatedly . go and meet the management .
