Proof of residence in delhi for cghs flat

Hi Team,

I am a member of CGHS and my date of application for membership is 10 Aug 2003 as per the records. In Dec 2011, I was asked to submit the details that I was resident of Delhi for 3 previous year from 10 Aug 2003. The society is nearing completion and the draw of lot is pending.

I submitted my passport which was issued on 28th Aug 2000. So the RCS rejected the same.

Then I submitted a letter from the the society where I was staying in year 2000. I had taken the letter dated 27th Aug 2000, which stated that I was co-occupant ( along with my friends father) of the flat ( in CGHS in Delhi) since Jun-2000.
The RCS has rejected that letter as well.

I have also come across a circular from RCS

No.F47/OGH/Coop/92/5849 to 5900 Dated: 16.12.1992

Which says that the proof of residence in Delhi is not must for the membership of CGHS.

1. Can you help as can the RCS reject the letter from the CGHS office as not a valid proof of residence in Delhi?

2. Do I need to have proof of residence for my stay in Delhi for 3 years on date of application?

3. What are the document that can be submitted as valid proof of residence in 2000 in delhi?

If they ignore this circular.

You should ask them under RTI following question-

1. whether proof of residence in Delhi is must.

2. What is the present status of your application.

3. If it is pending what are the reasons that your application is not being entertained.

4. What is the time limit for finalizing the application forms.

I hope they can not provide wrong information.

You should serve a legal notice with the help of a lawyer and should insist over the notification as well as your letter pertaining to March 2000. Even if RCS do not pay heed then immediately file a civil suit against it and obtain injunction.

During some period, eligibility condition of resident of Delhi for three years was removed. Kindly check the circulars which are available on website of RCS. You have a writ remedy if the RCS does not follow law.

Instructions issued in 1992 might have been changed. Pl check the latest circulars on the subject. The latest circular may give the details of the kind of proof required. Even the PRO in office of the RCS may provide you with the details.
