Maintenance for wife & son

If at the time of divorce, if wife has hugge property that is why wife is not claim maint for childrens and herself. lateron she demands maint from husband. can husband demand the property details which is their at the time of divorce? while defending maint case. If so to what extent.

Unless the property is of income generating one, it is not taken into consideration by the court.

The court co considers the present status of the parties , not what they were at the time of divorce.

Dear Querist
if the wife is not able to maintain herself, she have right to claim maintinence from her husband, property is not an issue but property will not be earn any income as Mr. Burman informed.

yes, the court will only considered the "Source of income" not the lying property/ assets.
further if the wife become unable to maintain herself then surely court will issue decree in her favor.

In fact the ex-husband can demand on affidavit, what all properties and income wife has in order for court to ascertain whether a ground for grant of maintenance is made out or not.
