Sale of prpoert

(Querist) 02 January 2012 This query is : Resolved
Dear Experts,
My father purchased 2800 sq.feet plot in Ghaziabad (UP) of Ghaziabad development authority (GDA). The land was originally allotted to Mr.Singh from whom my father purchased this land. The sale deed was registered and power of attorney was given to my mother. Both my mother and father have expired with a will in my name. I wanted to transfer this property in name so i went to GDA office. The GDA officials told me that this property is not registered with them and it is in the name of original allotee (Mr.Singh)and since my mother who had POA has expired so i have no right. Please tell me what legal action can be taken in this case. Thanks

No legal action can now be taken .
You are advised to approach Mr.Singh, and request him to execute a registered sale deed in your favor.

Then you need to approach his heirs.his mother, widow, sons, and daughters are his class I heirs in law with equal rights.
How old is the possession and what is the possessory activity??None,i think and mutation also undone.A blunder has been committed on your part,a sale deed was desired by your mother either in your or in your fathers favor. The day Mr.Singh died, the POA loosed its value, then even if your mother were alive to survive Mr.singh, her right as POA did not survive.
You have been sleeping about your right.
