Can Registrar of Societies deny registration of non profit society on ground that the words "National" & "India" in the name "National Association of Citizen's Rights India" violates the following in THE SCHEDULE of THE EMBLEMS AND NAMES (PREVENTION OF IMPROPER USE) ACT, 1950 or any other law?:

7.Any name which may suggest or be calculated to suggest:-

( i ) The patronage of the Government of India or the Government of a State; or

( ii ) Connection with any local authority or any corporation or body constituted by the Government under any law for the time being in force.

These types of socieities are permitted by the Society Registrar. If your registrar is refusing to register, ask them to return it along with their notes.

Then file a an appeal as follows:-

Before Inspector General of Registration, Chennai
Appeal u/s __ ___________ Societies Registration Act.

Appeal No. 2011

Against No.___/__/2011
(On the file of District Registrar of Societies, _____ City dated __.__.2011)

The IG will conduct an inquiry and then will pass suitable orders.

Even if the IG is not passing orders in your favour, you can approach the High Court.

Since the terms national, India, Indian, etc., confuse people as if the organisations with such names are the Central Government organisation, such names are barred to be used in the names of private companies or societes.

It is difficult to be agree with Barman and Arunagiri in view of specific bar of use of the desired words for societies and companies even though they may not extract profits.

Sir then how come National Panasonic India Limited is registered as company? It has both the words "National" and "India" in it?

Opinion of Advocate Arunagiri and Devajyoti Burman seems to be correct. If we go to http://www.delhi.gov.in/wps/wcm/connect/doit_industry/Department+of+Industries/our+Services1/Society+Name+Search and type the word "National" in the box Society Name and click Show Data, a long list of societies having names that include both the words "National" and "India"
