Trust deed

(Querist) 25 November 2011 This query is : Resolved 
A public charitable trust registered during 1974. The original trustees have either expired or resigned. The new trustees wants to amend the trust deed to include additional objectives which is also for general utility purpose only.
Kindly clarify

They can, if they were made trustees during the lifetime of earlier trustees.

If new trustees are taken as per the method provided in the PT entry and approved by the Dy.Charity Commissioner,in that case they may pass resolution of carrying out amendments in the objects,submit them to the Dy.C.C.and if approved,can be incorporated.But if new Trustees are not approved by the Dy.CC,they -as benefeficaries can move the CC for framing a scheme.

You shall have to study the bye-laws/clauses of trust deed and should have to act accordingly.

tom! The querist and some other persons have replaced the original trustees and these replaced persons now want to change the bye laws of Trust deed so he wants to know its procedure.

It all depend on the contents of the Original Trust Deed and its Bye-Laws.
Consult a lawyer in person with these documents.
