Marriage Registration in case the Bride is from Nepal

(Querist) 14 May 2009 This query is : Resolved
Hi,
Had a query on how to register a Hindu Marriage between the Indian Groom and Nepalese Bride. I heard of Foreign Marriage Reg Act but would it apply also to this case as in case of India and Nepal there is no official system of Registration of Entry and Exit (Visa's).

Please write to me in case more inputs are needed

Thanks in Advance

Rajendra

According to the Foreign Marriage Act, a foreign country" means a country or place outside India, and includes a ship which is for the time being in the territorial waters of such a country or place, since the bride is from a foreign land the marriage has to be registered under the special law.

Hi,
I get ur point friends but the challenge is that even from the Indian Embassy in Kathmandu there was no clear answer to this it responded saying give notice to embassy, newspapers ads etc.

Is somebody aware of some other way out to this because the Marriage Registration is now mandatory and for the bride to achieve any legal and constitutional recognition in future in india this seems to be the basic need.

Any other ideas are welcome as well

Thanks

Sir,
I have a little confusion about your querry:-
1) As you used the term "Hindu Marriage", whether the marriage was performed through Hindu rites and rituals in India?
2) If yes, whether the bride was a Hindu by religion?
3) If No, whether she was converted/ made a faith in Hinduism before the marriage?
4) If yes, then what is the problems in registration of marriage before Marriage Registrar in India?

Hi Sanjay,
To answer your query as under
1) Yes the marriage was performed according to Hindu Rituals in a Temple in Nepal as the Bride was from Nepal and in this case the Groom had Travelled to Birdes Place to get married.
2) Yes the Bride was a Hindu Brahmin by Religion as well as the Groom
4) The Problem is the Bride doesnot have any Indian Docs which are the pre-requisite for the Registrar to Register the Marriage.

Hope i have answered

Regards
