Cases with same fir should be heard as one combined case in dhc

(Querist) 16 November 2011 This query is : Resolved
Hi Expert,

I have been convicted last year(for 5 yrs RI) in one case.For this, one appeal is pending in DHC.
Also nine others cases have been decided recently in Tis Hazari.(3 yr RI)

All these 10 cases arises from same FIR.
Same sections,same DWs,same PWs,same accused same respondenats.

Now I will appeal against these 9 cases in DHC. So I want to know

1.) Whether all these 10 cases will be heared combinedly in DHC or not?
2.) The time I have spent in first case(more than 1 year) in JC will also accomodate for other 9 cases or not?

It depends on the court but generally when cases are of similar nature they are get connected and decided together. Suggest you counsel to make request to the court in this regard.

1. Cases can be consolidated & disposed of together;
2.If you were arrested & your arrest is shown in all those cases set off may be possible.
This is up to ur advocate to plead & argue.

Generally cases of similar nature have to be clubbed for hearing.
