Regardinf rental properties

I took a 1 bhk flat with my college in Mumbai.Once the rent agreement is done after that she did not paid rent as the rent should be divided by both.also she did not paid any electricity bill.our lock in period is complete.How can i moved out from this flat.as i loss lot of money also i am leaving in a hall.my landlord says its ur matters.

if the lock in period is over inform the landlady of your intention to vacate the premises. give one month notice if the agreeement mentions one month notice is necessary .

agreement has both of us.So i alone can leave after giving notice period.thats my basic concern.I will give one month notice.Because i am flustrated now.I am giving the money and living in hall.i want to know what can be done leagally.

also what can be done about that type of shared aprtment.how can i claim my money.
because we are giving the cash and she is give half or sometimes not the whole money so what can be done.we both give security deposit.

First move out of this place with or without giving any notice.
If the rent agreement you agreed for bearing the half shares amongst yourselves then only option left to you is file a suit for recovery of your half share from your colleague.
Kindly notice- It is hell not hall, it is colleague not college.

rent agreement having the both names but it does not mention the share its mention the whole rent of the flat.also we have one month notice.i just want to move out this place without any deposit loss.And i want to know the that if i am giving notice then i have to give replacement.Its not mention in agreement.

once both the names are there on agreement then both are equally liable for the rent. hence pay your share give notice of leaving place of your stay. was it a paying guest agreement.

Dear Anonymous,

I would strongly recommend what Mr.Sethi said....

Inform your landlady that you want to vacate the house and give her one month's notice from your side and ask her to draft a fresh agreement with the colleague of yours.... And ask her for the deposit back.... simple.... If she doesnot give you the deposit then move to courts....


Tell this to her and then move out.... your lockin period is over you are not legally bound to stay in the same house... if your colleague wants it's her problem...

In the absence of any share decided in the agreement it would be presumed that you both have to share 1/2 and 1/2 in every expenditure cost as rent or other utilities like electricity taxes etc.

you should not have paid the full amount of rent. if the agreement has been jointly executed in fvaour of you and your colleague why did you continue paying full amount if your colleague refused to make any payment .

if you had failed to pay the landlady would have requested you to vacate the premises.

your colleague is really smart .

now issue notice and vacate . consult a local lawyer for recovery of amount paid by you towards colleague share

Rhanks all i will give notice to my landlord.Lets see what happened i have informed her about my coulege's habbit but she says manage urself i need my full rent.my coulege used to give half rent and always said yar kal le lena attitude.i dont have proof for that bcase i paid cash but i informed my landlord and broker for that.

i have given the notice to my landlord.They said they will not give me security.I have to give replacement.When i was talking to my landlord my coulege ia talking very sweet to her.And when she come to know that i have given notice she clean the house and she initiate for other room problems sothat i will not raise the issue of money.she dont want to left the house.And if i left she is saying i will took deposit.becoz my landlord is saying he will give money when 11 month is over.she is going to US what can i do.

in that case only option for you is to stop paying rent . the landlord is refusing to return deposit . your colleague is not paying her share . if you refuse to pay rent the landord will issue you notice for termination of agreement .

consult a local lawyer .
