Cheque return charge

Hello,
There was a cheque issued to a credit card company. Funds were available in the a/c, however forgot to sign the cheque. The CC company send the cheque to my bank and they both have charged me with payment dishonor fee. Shouldn't this cheque be considered as non payment only.

The instance is both dishonour of cheque as well as non-payment of the amount due by the due date.

The Credit Card Company duly inform the users about their charge in case of dishonour of cheque and as well as the penalty for non-payment of dues.

On the other hand the banker also charges the overhead charges as the fee for their service which they have to render in making fake transaction on behalf of their customer.

The cheque should at first instance not be sent to the bank for clearance as there was no signature by the CC company. The cheque would never clear.

why should the cc company send the cheque at the first instance as the signature is not there.

Dear Prakash,

This is with reference to your supplementary query.

Instead of finding fault with the cc company, the drawer of cheque, himself, should check before posting in the drop box that there should not remain any discrepancy in the cheque.

In fact, some persons are in the habit of issuing cheque without signature just to postpone payment so that there cheque should not get bounced on account of non-availability of funds and they keep track of the cheque when that comes to the bank for clearance. If funds are available by that date they just sign before the banker to complete the transaction. But, when they are not able to provide funds by the date of payment they prefer to get the cheque returned on account of being not signed, as that offence is much less serious than the dishonour of cheque on account of shortage of funds.
