Ndps 8/25 crpc 173(8)

1. I sold my car in 2004 to Mr. Tajinder. RC is not transferred till date. So car is still in my name.

2. The car was sold to next person and so on. Car was sold 3 or 4 times. But car remained in my name.

3. As per FIR of Dec, 2009, this car was found being used in traficking of afeem with some other car. However in FIR, it is written about my car that nothing illegal item was found in my car. Still car was arrested because it was being driven by a member of that gang (which was carrying afeem in other car).

2. I have proof that i sold car.
A. delivery receipt (2004)
b. cash receipt (2004)
C. car insurance paper (2005) in favour of Mr. Tajinder
D. delhi police challan in name of Mr. Tajinder
E. Affidevit (2010) of Mr. Tejinder that he bought car from me in 2004.

3. Now SHO is framing charges on me u/s 8/25 of CRPC 173(8).

4. What is my legal status?

5. What should I do?

6. I dont want to enter into court battle. That is a never ending process. I want to convince SHO so that he should focus his investigation on Mr. Tajinder and further.

It is your mistake, you could have informed the RTO regarding the sale of the car to other person when the purchase didn't get it transferred in his name. Definitely police people will charge you because car is seized, which is in your name.
You produce all the documents to the police officer, inspite of it if your name appears in the FIR take the anticipatory bail because it is non bailable offence and challenge FIR in the high court.

Fatal it proved to you though in practice it so goes often,your case is a good lesson to others.
