What is the legal difference between Probationary Period,Trainee Period and Apprenticeship Period, in context of employment.
In an employment advertiement,it was told that the Apprenticeship and Training period would not be considered for Post-qualification experience. So,if one had joined a company as a Probationary Officer, then shall his probationary period of service be considered for Post-qualification experience?

Probationary period shall definitely be considered as Post Qualification period as given in the facts.

Apprentice Trainee is an individual who is receiving stipend from the government and company they are into. Apprenticeship Training is a fixed a term contract, usually for one year. After that government stipend will not be available and company can continue availing his/her service if they wish to. Also, an individual who underwent apprenticeship training from one firm cannot go for the same in another company benefiting the stipend. There is an Apprenticeship Act and a body who takes care of this. Companies do register their apprenticeship hiring with this body so that they will do the further processing of stipend.

Actually this is a learning opportunity for freshers. And they have very minimum responsibilities.

Trainee employee is the one employed by the company after the completion of training period he/she will be absorbed if things are going normal. He is receiving salary as per the company policy.

Probation period is for the candidates who have been recruited (may be experienced or fresh) and put for certain period ( say 6 months) for observing their working capacity and on completion of the period, they may be absorbed in the regular pay roll of the company.

Dear Ray,

Probationery perid is the initial period on joining a service during which the employee's performance and conduct is kept under observation for proving his worth and capability to handle the post skillfully and efficiently. The confirmation normally follows the completion of probation period. During probation period the employee gets full pay and allowances on the prescribed scale for the post. The period on probation is also counted as an experience to be counted as his service.

Any short term training course (other than a regular diploma or degree) is not considered as a qualification, but as a part of enhancement of certain skills of the candidate. If training is conducted prior to appointment against a regular post that is neither considered as a part of service, nor full pay and allowances of the post are allowed. If decided to conmpensate only some fixed training spipend/allowance is allowed to the trainee. But if the training is a sort of in-service training course and is conducted while in service, the trainee gets full pay and allowances during that training period, as he was getting prior to joining training. That is normally treated as a part of service and is counted towards his experience.

Similarly, apprenticeship is a sort of training under some employer to earn skill to do a particular trade or profession in order to acquire skill for the performance of a job and is regulated under the Apprenticeship Act. The apprenticeship period is a learning cum working period for the employer. During apprenticeship period an apprentice gets some fixed stipend, as prescribed by the Government for the particular trade, profession or industry from the Government. But, it is not necessary that the same employer would provide some job after completion of apprenticeship. After apprenticeship period the candidate can apply anywhere for the job of the trade or profession he learnt during apprenticeship or can start his own business or profession. That of course is not considered as a regular qualification, but as a skill acquisition process and would not count as an experience of the candidate.
