Dear Experts
I lodged a cyber complaint against my wife in Feb,2011 with whom my divorce proceedings are in progress with the District Court, Tis Hazari Court.
My wife has abused the Social Networking Site, Facebook by creating a face book account in my name along with my Picture.
Using this account, she connects with my friends and family and maligns my character which is against my self respect and dignity.
Despite of myself telling her numerous times not to use the account in my name which I don’t operate and nor I have access to the same; She did not listen to me and still operates my account.
She sent the invitations to my family members and my friends and they added me assuming that it’s my account and once they are added she tarnishes my character.
I told all of my family members and friends that I don’t have a face book account and it’s my wife who is interacting with them, this has been going on for 1 year now and she has done extensive damage to my reputation and character across the world.
Besides Social networking site, she also used my yahoo email account to make friendship with the girls by sending them email messages and gathering evidence against me during divorce proceedings by maligning my image that I am a loose character person so that she can claim huge compensation during Divorce settlement.
My wife also tried to spoil my reputation at my work place by sending the mails asking about my whereabouts wherein she knows my house very well.
In lieu of the above facts, Cyber cell did investigations and called me on 7th Sept that my complaint is genuine and to meet them personally at PTS, Malviya nagar cyber cell office.
Kindly advise what will be next steps since I want to take stern action against my wife.
Also advise me Do I need to physically present for the hearings Or my Lawyer can handle the same? Being in the touring job I can't travel back to India every month for court hearing.....

your wife seems to be a smart . if what you have stated is true on completion of investigations cyber police will file complaint against your wife . you can in your divorce proceedings rely upon the complaint filed by cops .
it is advisable to remain present when your divorce proceedings are going on . at the stage of evidence you will have to remain personally present to furnish instructions to your lawyer

You need to come present on first hearing of investigation with the Cyber Crime Cell and thereafter your lawyer can see the progress on your behalf.
Once case is registered against your wife, you shall have to come present only at the time of the evidence and for rest of hearings, your lawyer can persue case on your behalf.
