Regarding adivasi land

(Querist) 07 September 2011 This query is : Resolved
One Adivasi has a self acquired landed property. Can he make a gift deed of some portion of his landed property to his relative, who is not an adivasi? Whether a subsequent transferee can get clear title of that land?
prabhakar singh (Expert) 07 September 2011
It might involve prior permission of the DM of district without which it may be treated unlawful illegal and void,so better first check in office of DM of your district only there after proceed as any subsequent permission shall not validate.Normally DM may not agree to grant permission of gift /sale by an Adivasi to a non Adivasi.

in maharashtra you have to obtain permission of district collector under section 36 and 36A of maharashtra land code before purchase of any adviasi land
