Regarding Gift Deed...

(Querist) 14 July 2011 This query is : Resolved
A gift deed for a flat is to be executed in Pune between mother and son. Other Two siblings are going to be witness for the same. Is it necessary for the witness to be signing in front of registrar or can they sign the deed at home and not go to registrar office?
n.k.sarin (Expert) 14 July 2011
It is necessary for the witness to sign in front of Registrar
Advocate Rajkumarlaxman (Expert) 14 July 2011
If the gift deed is to be registered then they have to come before the registar and sign. Donot take law in hand there are people who may do that. but it is wrong. One has to come before the Authority and sign the same
Advocate Rajkumarlaxman (Expert) 14 July 2011
if unregistered then he can do at home all the signatures. or only attestation before the NOTARY PUBLIC bu there also they have to come before NOTARY.
Advocate Bhartesh goyal (Expert) 15 July 2011
Witnesses have to sign before Sub Registrar.
bhagwat patil (Expert) 16 July 2011
Registration is essential.
R.Ramachandran (Expert) 16 July 2011
The querist is not wanting to know whether Registration is essential or not, he only wants to know whether the Witness is to be physically present before the Registrar for signing.
