Courts have drawn a distinction between fines that are compensatory in nature & those are penal in nature.

Some case are required. under Income Tax Act, 1961 & Criminal Procedure Code, 1973.

sir there are case law which has distinction between fines which are compensatory in nature & those are penal in nature.

I want some of the case law on the above matter related. Becasue under income tax act, 1961 if the fines are compensatory in nature then deduction is admissible otherwise not so which fines are compensatory in nature & those are penal in nature. Also under Crpc some fines are treated as a compensatory in nature & others are penal in nature. Which are they?
