what is the procedure of criminial case

(Querist) 25 June 2011 This query is : Resolved 
a criminal case has been filed by my brother and then the case has been goes to local police station and after that investigation was done it has been found that the plot alloted to my father was rightly transfered to me, the police has made investigations to sub-registrar,DDA,and the witness on the conveyance deed and then it was found that plot was rightly transfered and now the police submitted the report in the magistrate office and sir now you are requested to tell me what is the further procedure of the magistrate?

now the magistrate if satisfied with the report of the investigating officer then may discharge the accused therefore the case will be closed against your father.

if not then the magistrate may hold further inquiry and will continue with the trial.

rest of the technicalities will be apprised to you by your lawyer.

The magistrate will close the case in the FIR stage itself. So, the question of acquitting will not arise.

You mean to say that the investigating officer filed the final report in the case . But it is not all over . The court will provide the opportunity to the other party to file the protest against that final report .If he files the protest,then either the magistrate may send it for the re-investigation or may itself record the statement 200 and 202cr.p.c.
