father lodged case of theft on daughter

Respected sir, my dad missed 4 of his cheques & out of which one of cheque amount of Rs 5000/- taken by my elder sister.about other cheques my sister doesnt know anything. my sis got arrested & dad felt bad, so he took her back by bail. now my mom and dad both are no more. my sis has 3 years old child. and she is pregnant too. & stays far from bandra court. section 380 & 420 is there.
is there any chance of case dismiss?? or any lawyer whom we can contact.? any way for one time sitting settlment?? please guide.

If the complainant is your father who is no more, now the case can be disposed only on merit, and the fate of the case depends on the evidence.

With the death of the de facto complainant, the case will come to an end when his legal heirs are also not willing to carry on with the case.

in the same theft matter my dad complained & registered FIR. against my sis. out of 4 missing cheques. the total amount of Rs 45000/- were withdrawn from my dad's bank account. in case of witness there are few statment of bank workers. but nobody could prove. & in final investigation by police. there was acceptance of Rs 5000/- was taken by my sis without dad's permission. that time we had few guest at home. even they also could be cheater. we dont knw who else more were involve in the matter. even my sis is not aware of this.in the matter is under extion 380 & 420 ipc. complainant is my dad he expired on 14th april 2007. case was logged on 2006.this is in mumbai's bandra (E) court. i need help to solve or dispose this case. my sis is really fed up with & want help to solve the matter in as early as possible. i need contact no of advocate who can help me to solve this. well thank you all of you for kind support

Since your father is dead, you will have to approach the court and file application stating all the facts. File a compromise signed by you and your sister. Offence u/s 420 is compoundable. Request the magistrate for expeditious hearing in view of compromise. Such a request is generally allowed. Contact me on my email vpalnitkar@gmail.com. I will suggest you a good lawyer.

Since, your father has already dies, the only solution lies in the legal heirs of the plaintiff agree not to pursue the case and withdraw the case against your sister. You can convince the other brothers and sisters.
