Eviction of Tenant

Querist : Anonymous (Querist) 30 May 2011 This query is : Resolved 
District court Dehradun has passed order to my tenant to vacate my room at Dehradun, giving him one month time. also directed him to pay pending Rent. Now what i have to Do.I should go to police or i should serve first Judgment copy to tenant.Regards.

Serve a judgement copy on your tenant and also demand that he vacate the premises and also pay up the arrears as ordered by the court. He has time of one month to do that and if he does not do the same, file an execution petition against the party, seeking relief for both.

You should file petition for execution of decree. You cant go to police directly.

I think this author got the knowledge of the SC order on eviction through police.

Dear author,

You have to file the EP. If the tenant fails to vacate even after the orders passed in EP you will be given a police support, for forcibly evicting him.

One month period has been granted by court to vacate the rented premises to tenant so you have to wait till one month expires and if tenant fails to comply the order/decree in said period than you have to file execution petition.
