given the shop for rent without written agreement

sir,
my grandfather given a shop to rent for Rs.400/month since 20 years without any written agreement now the shop owner's son is maintaining the shop and he was not paying the rent of Rs.400/- since two years.what to do?requesting you to give your valuable advice.

SEND HIM A LEGAL NOTICE FOR PAYMENT OF RENT AND TERMINATE THE TENANCY AND IF DONT GET RENT IN TIME FILE A SUIT FOR EVICTION.

he residing and paying rent since 20 years, it deemed to be an acceptance and agreement by performance. so he can not have any ownership rights over that rented shop. for that you can get the arrears by serving a legal notice with specified duration to pay, and then you can file a petition for eviction in the court of law.
