498a and mother in law

my brother and sister-in-law both threating my mother to book in 498a ,my mother is in 76 year old senior citizen.and the brother is married since 15 years.can a daughter in law file a case only on mother in law and not on her husbands in this 498a act?if so how to get-rid-off it?

Separate your brother and sister-in-law from your mother.

its better to separate them....

the purpose is to ensure peaceful life for 76 yrs old lady...we dont know the actual facts...but there has been a massive misuse of legal provisions...it will be better to maintain cool and separate them.

in case the dispute is because of family property then let it be solved amicably...

yes it is a mater of family property.the property is in the name of the mother but she got it from her father,but no recored of gift.but the mother is the owner of the property on paper.she is forced by her sons to give them their share.for this reson she is bein turtured and every day she has been thretend.As the son is an advocate the police is not taking any action.despite of protection order from the hon'ble high court of orissa.the old lady wish to spend her last lap of life picefully in her own house.there is a partition suite filed by the advocate son saying that it it fathers property as the mother is not an urnining member.mother stays in a misurable condition.the son use slang language every day in dranken condition and the daughter in law abuse like anything.in this condition can it possible to evict the son? can a mother evict a son ? if yes in how?
