Registration of land after death

hello
my father died last year leaving me,my bro n mom.we've a plot of land in his name.i came to know that my grandma can also ask for a share in d property through this club.But we've family members certificate only in our 3 names(no grandma).we've decided to register d plot in my mom's name. kindly tel us what should be done.. wat sort of agreement shld be registered ... explain briefly as i am not familiar wid d practices followed? do we have to reliquish or settle?

Since your father did not leave any WILL, the property will go by way of inheritance equally to all the Class-I heirs, namely widowed wife, son(s), daughter(s) and mother.
IF YOU WANT TO TRANSFER THE PROPERTY IN YOUR MOTHER'S NAME, THEN ALL THE OTHER LEGAL HEIRS (INCLUDING YOUR GRAND MOTHER) HAS TO GIVE A REGISTERED RELINQUISHMENT DEED relinquishing their respective shares in favour of your MOTHER.

you cannot deprive the legitimate right of your grand mother since your grandmother is also one of the class one heir. By executing any sale deed, release deed or settlement deed without the consent of your grandmother will not affect the right of your grandmother.

if want to get the property in your,your bro and your mother name and this act came to the knowledge of your GM she can claim her share. So better convince her and try to get rights relinquish deed from your GM

Right of your grand mother is always there since your grandmother is also one of the class one heir.As you are asking this query your granny might in good terms with your family.no doubt she will get an undivided share she have little chances to sabotage the title.for practical solution contact with details 9422773303

You can get the relinquished deed from all the persons who are interested in giving the property to you.
