sir i m a sister of a guy who have been killed by 3guys.the parent of a main accused have submitted a application on the bases of his 10cbse certificate according to which he is a juvenile but as per our investigation we got some evidence i.e, mcd birth certificate and his first class admission date of birth he is 20years old now to which document the prefrence will be given by the judge before taking any decision? plz help us .........

The court gives more weight to the public document while determining the age. If the court fails to decide then it can ask for ossification test.

Please see that whether they have obtained fresh birth certificate (after correction if any) by a court order.

In case, the m c d birth certificate is issued on the basis of entries made prior to issue of Board certificate, the birth certificate will prevail. entries of date of birth recorded for first class admission can be used as corroborative evidence.
