movable and immovable assets

Querist : Anonymous (Querist) 22 December 2010 This query is : Resolved

My wife has told she does not want any alimony or maintainence in past/present/future in the MOU.

But can she ask for my movable and immmovable assets in the future? if so under which section.?

adv. rajeev ( rajoo ) (Expert) 22 December 2010
wife alone cannot seek any share in the husband's property, if your sons and daughters claims any share in the properties then your wife's share to be given. She can ask her share thru., sons and daughters in immoveables.

While agreeign with Mr.rajoo,I would like to add that she is entitled to seek a charge for maintenance over these properties.
G. ARAVINTHAN (Expert) 22 December 2010
Advocate Rajoo is right.

But what is the motive of your wife in not having any interest in alimony?
Devajyoti Barman (Expert) 22 December 2010
Yes and the waiver of maintenance through any agreement has no force of law.
