In the suit set exparte against me I have field Affidavit with
Petition u/s 5 of limitation Act for condone delay of 453 days to set aside exparte decree,
Petition under order 9 Rule 13 of C.P.C.
The Respondent has field his counter .
I referred the book "Law of Limitation " by
Hari Dev Kohli , and find many judgements to support my Petition u/s 5 ,
I feel my Affidavit has to be Changed , to add additional points to support my stand .
The suite is before "Asst City Civil Court At Chennai.
HOW DO I PROCEED ??

What is this Order 9 Rule 13 ?

I find there are so many volumes on C.P.C.

I want to buy a GOOD BOOK reasonably priced , giving all about C.P.C.
Please suggest me a good Author

Advocates ,but I am an Engineer got into disputes during the course of my business ,just interested to know what the law and rules says .

Mr. Ramkrishna,
You may purchase C.P.C. authored by Justice C.K. Thakkar (Tekwani). It is best text book on the subject for students and teachers of Law. Price would be ranging between 300/- to 400/-.

However, I also seek an advice from you - I do face many problems relating to engineering viz. fault in electric wire,leakage in water pipe, moisture in building, fault in motor car etc.etc.. Kindly suggest a low priced handy book giving all about engineering so that I may cure the defects without help of mechanic.

An application can be filed under this provision to setaside the exparte decree passed in the suit.
