Public Prosecutor

All esteemed experts need your advise in respect of a criminal case.There is a case filed by my client as well as on the same incident the accused in the complaint filed by my client has also filed a case against my client, Both the case are registered through police and chargesheet has been filed in the Magistrate's Court. Now the trial of both the cases has commenced, I have raised a query thst same Public Prosecutor cannot conduct both the cases. The Magistrate has asked me to give judgement on my query. Kindly provide me any citations or suggestions. Thanks a lot

There is no citation but to protect the interest of your client you can assist the public prosecutor.

The same public prosecutor can conduct both the cases. The complainant is the State, not the parties. So, no illegality.
