suit fille fees

since i am filiing a partition suit please guide me as to what would be the court fees for filling a partition suit in uttar pradesh ? also wanted to know will i have to give a court fees according to the total current value of the property, or 1/4th share.? kindly guide me....

YOU MAY KINDLY PERSONALY VISIT THE LOCAL CIVIL COURT REGISTRAR OFFICE ,THEY HAVE THE EXACT TABLE OF COURT FEES AND ALSO REFER COURT FEES ACT. YOU WILL SUCCEED.GOOD LUCK..IN GENERAL AS PER VALUE OF YOUR SHARE IN YOUR PROPERTY YOU HAVE TO AFFIX COURT FEE STAMPS.

You have to pay advolerem court fee on the value of your total claim.Provided if it is immovable property half of the court fee may be paid.

If you have been ousted from the possession of the property, you have to pay CF on your share value .The meaning of Ouster is interpreted by SC in Neelawati case. If you are in possession, even symbolic, a fix court fee is payable

Mr. Thukral has given the full answer. A nominal CF is to be paid on a partition suit without a prayer for recovery of possession.
