This case pertains to a family of 4 who has managed to obtain false ST certificate from the tashildar and utilising all the benifits.Their original caste: KANIYAR, a 2A Backward class as per Art-16 of the constitution (KARNATAKA) and a native of Kullanakoppalu village, T Narasipura Taluk, Mysore District.
Their clame is that they belong to KANIYAN a Scheduled Tribe restricted to KOLLEGAL Taluk of Chamarajanagar(earlier Mysore district)as per the Presidential Notification 1950.
Evidences to prove that the the person who has availed the false ST certificate as a KANIYAN are
School records: Primary, Secondary, High School admission extract(Father of the person has filled way back in 1956)and School leaving certificates,Transfer certificates and college records. where in the caste mentioned is KANIYAR a Backward Class, 2A.
Service register: The name of the caste is tampered as Kaniyan by overwriting the letter r in Kaniyar to n. While entering into the service he has not availed the any reservation as a Scheduled Tribe but for his promotion he first manages to get ST certificate from the Tahsildar Mysore and gets promoted as Inspector from First Division Assistant in the Department of Commercial Taxes.Later when he comes to Know that the so issued ST certificate by the Tasildar, Mysore is not a valid and that he should get the certificate from the Tasildar Kollegal,in 1979, he manages to get a false ST Certificate from Kollegal Tassildar by giving the address of one of his wife's relative and claims the relative as his paternal uncle.
The Service register was sent to Forensic Lab and the report states that the Service register has been tampered and that it is KANIYAR and not KANIYAN as claimed by the accuse.
Evidences to prove the accuse belongs to Kullana Koppalu villaga, T Narasipur Taluk mysore District: 1. Srinivasa Murthy's (accuse) father K A Madhavaiah was a Govt Servent and worked as a compounder in the Department of Health and Family welfare, his confidential report cleary shows that he was born in 1917 at KullanaKoppalu, T Narasipura. His permanent residential address: Kullanakoppalu, T N Pura Mysore dist. He also declares that he possess wet lands of 6 acers which is ancestral property.
2.Marriage Invitationof Srinivasa Murthy's parents: Marriage has taken place in the bridegrooms place namely Kullana Koppalu villaga, T Narasipur Taluk, Mysore Dist.
3.Pallu Patra or vyavastha Patra registered at Bannur Sub registrar Office Bannur in 1949 by Sri Anantha Padma Nabiah,care taking father of K A Madhavaiah. As per the vyasthaPatra Sri Anantha Padmanabiah and his wife Rangalla had no issues out of marriage hence the take up the responsibility of taking care of Anantha Padmanabiah's younger brothers son K A Madhavaiah by giving him the necessary schooling, getting him a job, marriage and finally through the vyavastha prata Anantha Padmanabiah transfers his entire property(ancestral and self acquired property) wet land and the house at Kullankoppalu village, T N Pura to K A Madhavaiah at the age of 70 (1949).
3. RTC- Revenue records extract of K A Madhaviah from the tasildar office Kollegal shows that the land at various survey No at Kullankoppalu village is in the name of K A Madhavaiah (1962,1963,1965)
Srinivasa Murthy claims that K A Madhaviah is his father and that he belongs to Kaniyan and a native of kollegala.He doesnt have any documents to prove that his father belongs to Kaniyan caste and a native of Kullana Kopalu but submits a family tree issued by the village Accountant, Bangalore North District but not from Kollegal.In the family tree a fictitious name called CHIKKANNA Kaniyan has been incorporated and that this person is been stated as his great grand father ie, K A Madhavaiah's grand father and Anantha Padmanabiah's father but as per the vyavastha Patra Anantha Padmanabiah's father is KOPPA MADHAVAIAH. futher he claims that Chikkanna Kaniyan possess2.18 acres of land at Kollegal.The revenue recordes of chikkanna Kaniyan at kollegal reveals that he possessed 2.18 acers of land and that it has been transfered to Subbaraya Shetty and not to either Anantha Padmanabiah or K A Madhavaiah.Further with respect to any documents pertaining to the claim of Srinivasa Murthy that Chikkanna Kaniyan and his father, grand father or himself is available in the tasildar Kollegal office it's been endorsed that they donot have any records with them to establish the relationship.Now he has obtained a family tree in the name of Sri Krishna Swamy, who had helped him to obtain a false ST certificate by giving Srinivasa Murthy his home address and thus authenticating the stand that his great grand father is Chikkanna Kaniyan.

My query is that once when we come to know that the a non ST family is enjoying the benifits given to a real ST though i am not agreived by it any way can i file a petition before the High Court? Are these people not anti social elements in the society? The tasildar Kollegal, District Caste Verification Committee and also the State Caste vertification are so corrupt that they have parted with the fake family and sheltering the culprits eventhough sufficiant evidences to prove that they belong to backward class and they are the native of Kullana Koppalu T Narasipur taluk and not the native of Kollegal as they claim to be.
