Adjournment only on because RTI is awaited ??

Querist : Anonymous (Querist) 16 October 2010 This query is : Resolved
Day after Tomorrow is the date of argumentation, can the opponent take an adjournment just because he is awaiting reply of RTI filed just seven days back, while he has already filed reply to the petition three months back.I filed the petition 6 month back.

Next time the opponent may say that he is awaiting reply of first appeal, next he may say he is awaiting reply of second appeal, next he may say that he has filed a fresh RTI.....

This way won't RTI become a ploy for getting adjournments,if court accept such pleas ?

There are no of easy simple and legal methods to get the case prolonged. Even if one party is complaining that the case is being delayed by the other side may be basis of even contempt petition for attempt to prejudice the court.

If you object for RTI application result the party can apply for summons from the same court and if not granted can go upto highest court only this issue only which will suck your energy and resources.

LAW IS A DOUBLE EDGED SWORD AND SAME ACTION CAN BE FAR AND AGAINST.

Mr Prabhakar,elaborate please.

The court cannot wait till the RTI reply comes. Some RTI cases are dragged for so many months. So, give some other reason for adjournment. Your counsel knows the better way to get the adjournments.
