ANCESTRAL LAND TAKEN OVER BY THE GOVT.

Querist : Anonymous (Querist) 02 October 2010 This query is : Resolved
I HAVE AN ANCESTRAL LAND IN KUTCH,GUJAJRAT WHICH IS AN AGRICULTURAL LAND IN MY GRANDFATHERS NAME, BUT NOW IT HAS BEEN TAKEN OVER BY THE GOVT. DUE TO SOME REASONS NOT KNOWN TO ME.
I DONT HAVE THE EXACT PAPERS BUT THE VILLAGERS AND THE SARPANCH SAYS AND ITS NOTED THAT THIS LANDS BELONGS TO MY GRANDFATHER BEFORE THE GOVT. TOOK FROM US.
I DONT KNOW THE PROCEDURE HOW TO RECLAIM THAT LAND BACK FROM GOVT.
AND HOW DO I GET THOSE OWNERSHIP DOCUMENTS BACK.

go and check the revenue records, your grandfather name in case mentioned therein... tehsildar would know the details... in case the land was acquired under land acqusition act, now u can challenge the same as the objections have to be filed within a fixed period by way of reference under the Land acquistion act but yes you can get your compensation for taking away the land....

Which taluka and village pl.,when did you come to know of this ? You may get copy of VF VI i.e.Hakk Patrak, VF VII-XII i.e. cultivation inf. It is better that first you may obtain Hakk Patrak showing name of your grand father and subsequent Hakk Patrak showing the land confiscated by the govt.I could guess that since you are talking about your grand father, when Inam Abolition Act came into force in 1957,at that time if the land remained uncultivated for three years prior to 57,the land was declared govt.land under sec.10 of that Act.

U may not be able to get the land back but certainly U R entitled to compensation.
