Socializing judgement against errant litigants ?

Guest (Querist) 15 September 2010 This query is : Resolved
Can I circulate in the society, a judgement against my tenant for eviction, after getting physical eviction from him---so that I may take revenge of him, thus his social status would be tarnished and new people would be much aware before doing any type of dealing with him ,he may not succeed in troubling others like me,it would be a social service also.Could I be prosecuted for defamation if I do so???

Please answer.

Yes. You can do so but just for the purpose of intimating others about the decision taken by court in your matter pertaining to tenancy and no extra words should be used by you which may be termed as defamation. You are free to circulate the copies of your judgment and it do not fetch any defamation to tenant or contempt of court.

I think a litigant is not supposed to publicise a decision passed in his favour wantonly unless there is larger public interest is involved and any such attempt may bring liability to face prosecution for defamation.

I agree with Mr.Makkad. It cannot amount to defamation.
