Refund of court fees

Respected experts,

Can I claim refund of court fees if my plaint is rejected for lack of jurisdiction ?

No the order is final one and the court fees can not be returned.

If your plaint got selection due to lack of juristiction mean, you can't claim refund your court fee. But you can re present your plaint with concern court without saying further court fee. Thats all..

I agree with Mr Thanga Pandian

Immediate after return /rejection of plaint the plaintiff can present the said plaint before the proper court having jurisdiction with out paying any additional or second time Court Fee .The Court fee paid on original plaint is sufficient with in the same state.

yes. you have to present it before proper court having jurisdiction. if that court rejects it on some other ground then you can get refund.
