Survey No of Sub-divided plot

(Querist) 02 September 2010 This query is : Resolved
I am interested in an unapproved plot in Chennai whose title deed does not have the actual survey no. of the plot, ( S.No 100/1A which is subdivided from Survey No 100/1)
Instead it is mentioned as Plot no 4 with extent of 2400sqft contained in Survey No 100/1
Should the owner execute a rectification deed to correct the survey no
s.subramanian (Expert) 02 September 2010
Yes. Certainly. It has to be rectified.

I agree with Mr Subramanian
The clear details of sub division will required for clarity & Identification of property and for proper description .
R.Ranganathan (Expert) 03 September 2010
Clarify whether whether the sub-division of the S.No. 100/1 was done after the execution the title deed or before that. If after the execution of the title deed then no need of rectification. Also just because the Sub-division number is not there, the title deed cannot be said faulty, if it mentions the S.No. as 100/1.
Prabhakaran (Querist) 03 September 2010
The owner has got a patta in his name with the S.No 100/1A,
Is it possible that the sub-division could have happened after the execution of title deed and the patta is obtained for the new survey number
a.manoharan (Expert) 03 September 2010
Dear mr. prabhakaran.
The owner has got a patta in his name with the S.No 100/1A means that the said property was already sub-divided. Yes, it is possible that the sub-division could have happened after the execution of title deed to somebody only for the smaller extent of property from the larger extent and the patta is obtained for the new survey number after the said sale executed. Even, with that sale deed in your name, even U can go for subdivision by filing application with the Tahshildar. That is what MR.Ranganathan sir told U.OK?

I thnk rectification deed shall help to aviod future complications.
Prabhakaran (Querist) 04 September 2010
Thank you all
R.Ranganathan (Expert) 05 September 2010
No rectification is possible if the sub-division has been done after the execution of the sale deed. You have to apply for a separate patta based on your sale deed.
