Killing a thief:

If a thief broke into a house is the house owner of the house entitle to kill the thief by way of private defense:

the owner of the house has the right to private defense of life and property but he has no right to kill him if there was no occasion to believe that the thief had the intention to kill the house owner.The act of private defense should be proportionate with the threat.

TANX: Is there any difference in the application of private defence in common law countries like ENGLAND/US and INDIA in this matter?
