My Grand Mother Expired 10 Years Ago. As Per Wares Certificate The Land Is Divided Into Three Portions And Mutation is Also prepared Separately But Deviation Deed is not prepared. Now One Of The Three Person Again Gifted His Land To An Another Person And Mutation Is Also Prepared.

My Question Is How To Cancel The Gift Deed If The Gifted Person Is Desired To Cancel ?

Gift cannot be revoked
Advocate M.Bhadra (Expert) 10 February 2015
Gift Deed once executed can not revoke or cancel. Only court can revoke it if the donor and donee would agree and if there were any fraud or coercion at the time of execution by an application from the donor.

consent of donor and donee is necessary for cancellation of gift deed . once gift is made property passes on to donee . you would need court orders for setting aside gift deed

Gift once accepted is irrevocable and final.

A registered gift deed is irrevocable, the donor and donee if so desire to cancel, they may appear before the registrar and move a cancellation deed jointly.

It can be cancelled only when donor and donee both mutually agree for it or by a suit by donor against the donee wherein donor successfully proves that his CONSENT TO GIFT WAS TAINTED BY COERCION,FRAUD OR MISREPRESENTATION.
