This query is : Resolved
for the last 2yrs. tenant has not paid rent nor he is vacating he has just put lockand not carrying out any activity. he demands money to open lock.there is unregd. agreement for 11 months which stands expired. in case i file suit how much time it will take to conclude. pending case will he be paying rentto me or in court. earlier he was paying rent by means of crossed cheque.

IS IT A LEAVE AND LICENCE AGREEMENT ?
on account of failure of your licenceee to pay licence fees you have to go as per terms of your agreement .
if term has expired issue notice to licencee to hand over posession and also demand rentals for the priod h ahs continued in posession .
have you taken any security deposit?
period of disposal would depend upon pendency of suit in courts wherein you file suit for eviction .

yes my suggestion also very similar ajay sir.,
just issue notice for intimate the expiry of agreement, also for claim the arrears of rent.,
if there is no response mean just proceed as per law.. file a civil suit for evict your tenant, as well as for collecting the arrears of rent.

There is no point waiting for mercy of the tenant.
Send him a notice of eviction and file a suit for bona fide need.
The time differs from court to court and state to state depending upon multiple factors.

apart from the legal ways suggested above....my advice, though illegal in nature, is quite effective....seek help of a local police officer....butter his palms and enjoy your property.
its not easy for everyone to follow my opinion...but our system has gone so slow and ineffective that the tenants have become more like parasite upon landlords.
if you can handle the litigation pressure then file an eviction application against the said tenant under the relevant rent laws applicable in your state.

Yes I am agree with Mr. Kiran open lock of your property and take a possession of your property . Also file suit to recover arrears of rent with the help of advocate. More over Tenant does not carry any Activity. So disclose all these facts during filing suit.

I too, am inclined to agree with the views expressed by Mr.Kiran. Considering the uncertainty of the tenure of litigation and other aspects, though strictly not legal, such a bold action is the practical solution.
