Child visitation - contempt of court act 1971, under sec 2(b), 10 and 12

(Querist) 11 July 2015 This query is : Resolved
Hi Experts,

I have filed petition for contempt of court act 1971, under sec 2(b), 10 and 12 in HC for disobedience of child visitation order given by magistrate court in sub-petition of DV act. HC Section clerk returned for corrections. Section clerk orally asked me to change section as "Order 14 read with rule 10(1)" instead of contempt of court act. I said, the visitation order is given by magistrate court, so it should be by contempt of court section. Section clerk replied that I have to get sign on petition from "Advocate General", if i move this petition under "contempt of court". is it true? or is section clerk making my petition as dummy by my in-law influence? Please reply.

Thanks,
Kumar

You should have filed the petition in the Magistrate Court itself.

Hello Sir,

I am going to file corrected petition as per section clerk in few days. Another situation change came by yesterday (1-8-2015) in magistrate court as "main DV act petition has been disposed due to continuous non appearance of petitioner(wife)". Is my contempt petition being valid in High court? Please reply experts.

Thanks.
