Physical punishment is a grave cruelty on the part of husband as by doing so, he has invited not only possibilities of action of wife by way of 498A, DV act but also divorce petition.

If she is really subject to physical and mental assault by the husband then she can lodge an FIR to the Police u/sec.498a IPC and also file a case under Domestic Violence Act.She can seeks another relief by sending a complaint to the State Women Commission.

you cna warn your husband not to ever lift his hand upon you . going to cops will aggravate the case . try to reconcile with your husband . if he persistently hits you then file police complaint against him . file case under DV act

when the litigation is started between the husband and the wife than it become very difficult to patchup the matter and in this regard the relation become very weak. the wife can start the proceeding in this regard under 498 and DV Act

Actions can be several like u/s 498A, 323 ipc, u/s 12 of PWDV Act.
But if you do that you may well loose the marital life for good.
So weigh all the pros and cons before that. The slap made in a fit of rage may be ignored if there is usual love and affection between you.

Dear Mr.Pankaj,
Good question by Mr.Prabhakar. Try to avoid such things. It would be best for you and your family to live with your wife peaceful.
Otherwise lots of difficulty have to face.

Definitely, she can sue, but with the risk of straining relations more severely with husband.

:-) No brainer.
If you slap someone, the other party can sue you, irrespective of how you two are related.

If she wants to live with her husband, she forget about this incident and will try to rectify her attitude also.
Legal solution is different from practical approach.

Police and Courts are meant only for the purpose, the legislation (in India) is especially favouring WOMEN

It has nothing to do with law favoring women. It is a law irrespective of the parties.
