Filing petition against illegal owner of stilt parking.

Dear Sir,

I stay in thane since 2005 in co op hsg society. total members 28. after formation of society it was decided not to purchase stilt space for parking from builder. Still few members (6 out of 28) purchased the same from builder. In 2013 it was decided in the meeting that legal ownership of stilt is with society and no member is authorized to sale or purchase parking. After this also few members sold their parking to other members / new flat purchasers.

I would like to ask that where (in which court) we can file petition against such members?

Commercial space in residential building dispute

Hi,

Our building is to go in redevelopment, there is a commercial shop on the ground floor of the building, this shop has covered the open area and using that space since long. Though there is no agreement with the society that this space has been bought. Now that we are going into redevelopment the commercial shop owner is asking for the whole space (including the encroached area) to be considered for the redevelopment.
Few of the members are supporting the shop owner reason not know why?
My questions are
1. Is this legal to ask for the whole area, he says he is paying property tax for the whole area that is the only proof he has in his defence (there is no mention in building plan or agreement even maintenance bills are for the area that he had bought)?
2. If he can ask for the whole area, then can't a terrace flat owner ask for the same for his terrace?
3. Is there way that we can act on him knowing few members are supporting him?

Dicgc cover incase of one joint account with multiple FD

Sir,

If my bank fails, I hold a joint sb account with my wife. By we hold multiple fds...2L fds in my name and 1.10L worth fd in my wife's name. Kindly let me know if we will get 1L or 2L dicgc cover.

Stay validity if stay case dismissed for Default

My mother and my aunt had a joint agricultural land and during consolidation partition of this land was done and DDC and passed an order of partition. My aunt was not satisfied with the way partition was done and she went to high court against it in 2006. It was pending since then but 3 months back case was dismissed for default. Now she again went to high court for suit restoration and case is restored.
Now question is that stay on partition is still valid or not. This is because we went to SOC to do partition as per DDC order as case is dismissed so stay is not valid untill any further order is passed from high court. Please advise.

Interim stay

HC grants interim stay against order of transfer in a nain petition challenging transfer order.Later the main petition is dismissed.whether the petitioner is entitled for wages for the period of interim stay

Family settlement

Good morning, my father died without any will. My father has a wife , eldest son, four daughters i am the 4th daughter. my father has a self acquired house of 80 sq.yards .My mother is staying with me. All the three sisters and mother willing to sell their share in the house to me with some monetary benefits except my eldest brother. He neither looking after my mother nor willing to give me his share in the house. Still the house is in the name of my father. Please guide how to get the house registered on my name of all shares except my brother's. By leaving his share i.e leaving one room can i get the house registered on my name in sub registrar office. Whether I should apply for sale deed or otherwise any other way. Kindly suggest the best way. Thankyou

Withdrawal of Divorce case u/s 13 HMA

I had filed for divorce u/s 13 HMA in Oct 2016.
The respondent filed for Interim maintenance in June 2017.
No order for IM till date and hearing to start after failed meditation.
If IM is ordered in coming few months...there would be a huge arrears..( child is there from the wedlock).
Queries:
1. Under which section of CPC can I withdraw the Div petition ?
2. What if the judge says that he will first dispose the IM appl and then the withdrawal appl...( The whole purpose of filing the withdrawal appl is lost)..what best can be done in such situation ?
3. Can you pls share me a template of the Div withdrawal petition in case you have it ?

Pls note that the withdrawal is done with a sole intention of voiding the maintenance appl filed by the respondent.

Admission eligibility to regular llb after bbl

Dear Sir/Madam,

I seek a clarity regarding BBL (Bachelors in Business Law) conducted by Annamalai University.

is BBL through distance mode considered as a 3 year UG degree to serve the eligibility criteria of a regular LLB College Admission...?

As this BBL is a 3 year course which demands the +2 qualification as admission eligibility. .....Can I enroll to it in distance mode ..? can I take admission in any LLB college with this qualification after 3 years ?
or should I choose any other 3 year degreein distance mode like BBA/B.COM in order to confirm my LLB admission ?

Change address of society

ear Team ,

We Have society Registered under Societies ACT 1860 in Madhya Pradesh State we want to change it into Maharashtra State ,

Is there any process to change of state in Societies .
