Married daughter right in ancestral land

Hello Experts,

We are resident of Gurgaon and a Hindu Family


MY maternal Grandfather is having some acres of ancestral Land.
MY maternal GRANDFATHER IS ALWAYS RUDE TO MY MOM and give everything to my MAMA.
In 2014, He started transferring the Land in the name of my MAMA , when my mother resisted he cut off all the connection with my mother.

Then my maternal grandfather didn't transfer the Land but Executed a registered will to transfer all the ancestral property to son after his death.

Then she went to a Lawyer, The lawyer told my mother to file a suit for a declaration and simple injunction. She filed the case but the case got dismissed after 4 years in 2018.

The reason for dismissal was " Mere suit for declaration without possession is not maintainable".

Then she didn't appealed and now it is 2020.

Now I insisted my Mother to at least talk to lawyers,

One lawyer told me that ONLY suit for partition is maintainable so now again file a suit for partition and possession, losing a case for suit for declaration doesn't mean anything in right of a daughter in Parent's ancestral property.

One Lawyer is saying that again the appeal has to be filed but in High court for declaration only.

One Lawyer is saying that losing a case of declaration does not mean anything for a daughter and after the death of my maternal grandfather, we can get the land transfer in our name so no need to file any case.

We don't have any legal knowledge, SO PLEASE EXPERTS GUIDE ME WHAT IS RIGHT APPROACH AND HOW SHOULD I PROCEED NOW.

Dtvsv scheme

An assessment order was passed by ITO in our case, additions were made, we file first appeal to cit appeal. cit appeal dismissed our appeal, we file rectification to cit appeal as some facts were missed by her. She dismissed our rectification request. We again file recitifcation request to her. It was pending before her. Mean while Direct Tax Vivad Se Vishwas Scheme 2020 came and we file forms under this scheme. These forms were rejected by CIT with remarks that our first appeal was dismissed and instead of filing appeal to Tribunal, we again filed rectification of appeal to cit appeal, CIT admin rejected our form by saying that our appeal is not pending before any authority. now what is the remedy for us? According to my understanding recitifcation is part of appeal it is not a seperate case. And if our rectification request is pending it means, our appeal is not come to final conclusion till that rectification request disposed off. please suggest me what is remedy for us?

Driving license for one eyed person

What are the remedies if CMO or Driving License Officer is denying the driving license for a one-eyed person even after getting the required Medical certificate from AIIMS.

Husband is cheating and not picking up the call

Hello sir,

I got married in 2016 and I have a kid of 1.5 years. For 2 years, my husband was very rude to me and he use to drink and fight with me.

On November 2019, My husband got drunk and had a big fight with me, So I took my son and shifted to my Maternal home.

My in-laws are not saying anything to my husband and supporting him.

From past some months my mother and father are convincing my in-laws to solve the problem, we also tried to make them convince by other family members. (nothing is working).

Now no one is picking up the call.

Now I came to know by some of relatives that my husband started living with some other girl ( in LIVE IN RELATION).

1) What should I do now?

2) What remedies is available for me in the court and out of the court.

3) Should I go to mahila Police thana

4) My husband and inlaws has properties, Is my son entitled to get the share of property and maintenance? How can I raise my children on my own without support.

Please guide me

Chennai flat re development issues

There are 90 owners in a registered association of Flats in CHennai
The building is damaged and few are totally rendered unusable.
In a General Body Meeting attended by 67 owners, it was decided to reconstruct the flats through JV with a builder.
Now 89 owners have signed written consent to go for re-development through the builder
One owner is not cooperating.
Is there any legal remedy to get the owner onboard? All are suffering due to this one owner.
Kindly guide and suggest

Issue of duplicate share certificate

Dear Sir,
One of members of our housing society had applied for duplicate share certificate because his original share certificate was destroyed in fire. This fire occurred in the Bank from where he had taken housing loan and same was repaid/settled fully in 2019. So, let us know what are the documents that our society member has to submit to the society basis of which we can issue duplicate share certificate adhering byelaws of the society....Thanks.

My client is a builder and constructed residential apartment of 120 flats. On dt:10.10.2018 occupation certificate has taken and after that date 80 flats registrations done and prior to OC 40 flats registrations done. Now the department is telling that the assessee has to restrict their ITC in proportion to the flats registered before OC i.e. 33% of the ITC shall be utilised and the remaining shall be disallowed. Please enlighten on this issue.
