Need help to start resort

My client is planning to start a resort with club with membership of resort. I need to know the authorities/departments from which I can take permissions, clearances etc. Anybody is here can able to give comprehensive list in this regard?

Senior citizen act

A father filed a petition under senior citizenship act against his daughter.She is house wife and don't hv any source of income of her own. She is dependent on her husband. The Assistant commissioner had awarded Rs.2500/- against her.

Whether such order is maintainable?

Format of counter claim

Wife filed divorce petition against husband on the grounds of cruelty, desertion etc. Husband also want divorce but on same grounds against the wife.

I need format of counter objection in this matter. Can anybody help me out?

Maintenance from daughter

Father filed case against his daughter under THE MAINTENANCE AND WELFARE OF PARENTS AND SENIOR CITIZENS ACT, 2007. The daughter is married and living with her husband. She is ordinary house wife and not have earning of her own. Such case is maintainable? Kindly give me the rulings, if any.

Impleading application

It is a suit for recovery against the company. Company is not made a party. Only its directors made party. There is no any agreement regarding alleged loan. Defendants have taken contention that, the suit is bad for non-joinder of necessary party, ie., company. Specific issue has also been framed regarding non-joinder of necessary party. The plaintiff filed IA to implead the company as defendant when the case is posted for arguments. In the affidavit plaintiff says like this: "The defendants have arguing that the company has not been made party though the company is represented by its directors. With abundant precaution I am filing this application to implead the company as proposed defendant" My quarry is:

1. The affidavit filed by the plaintiff along with application to implead, clearly shows that, the plaintiff is not convinced that the company is necessary party. When he himself is not convinced that the company is a necessary party, whether such application can be allowed?

2. When the specific issue relating the non-joinder of necessary parties, application which nullifies the issue can be entertained?

Relieve letter in Pvt company

I am working in a private company. There is no any agreement between me and the company. I got a better opportunity. I tendered my resignation and requested to relieve me. But these people are not relieving me. My new employer is asking for relieve order.

I want to know the legal position as what remedy I hv?

Divorce

I hv asked a quarry earlier, I am not satisfied with the answers:

1) I asked about alimony. If wife is earning handsome salary, then is it fair to ask for alimony? whether court will give such alimony?

2) I asked for mandatory six months gap for first motion and second motion of divorce. I like to know whether it can be dispensed with or not?

Divorce by mutual consent

I and my wife are living separately since one and half years. She is working. SOn of 7 yrs is with me and daughter of 4 yrs is with her. The talks of living together were on for all these one and half years. I used to visit my inlaws place and we have spent 15 days of vacation together. But now it seems that, our marriage will not continue in these circumstances. I have few quarried in this regard:

1) since one and half years we are not living together. She got ration card separately and gas connection for herself. But we used to meet and also spent 15 days together. She is working, but not tried to get transfer to my place. My question is in the situation above, after 6 months can I claim divorce on the ground of desertion?

2) What is the recent legal status of 6 months mandatory period after filing divorce on mutual consent?

3) If she is ready for mutual consent and to look after daughter, is is necessary to give alimony? She is working and earning around 20K pm.

4) Her working timings is 4 m to 11 m. Can I ask for custody of daughter on the ground that, she is not able to look after her..?

mortgage of Ancestral property

I am having ancestral property. I have two sisters. There is no any partition between us. After the death of my father, my name has been mutated in Record of Rights. Then I was minor and my mother was minor guardian. After majority, guardian is not on records 27 years ago. My sisters are married and residing happily with their families.

I approached a Bank for loan. After studying my case, bank advocate given opinion that, my title is not clear because of sisters. He told that, as per newly amended HIndu Law, sisters also got share in property and hence mortgage cannot be created without the consent of my sisters. He told that, because there is no relinquishment deed or partition deed, their claim exists. My sisters are married before 20 yrs.
Please clarify.
